Refund & Cancellation Policy

This Refund & Cancellation Policy ("Policy") governs all purchases, subscriptions, credit transactions, and payment-related matters for TextCloaker and TextCloaker Premium, operated by Graham Zemel LLC ("we", "us", "our"). By subscribing to or making any purchase through the Service, you ("you", "the user", "customer") agree to be bound by this Policy in its entirety.
This Policy should be read in conjunction with our Terms of Service. In the event of any conflict between this Policy and the Terms of Service, the more restrictive provision shall apply.
1. General Refund Policy
All sales are final. All payments made for TextCloaker Premium subscriptions, credit purchases, and any other transactions are non-refundable except as may be required by applicable law.
1.1 Non-Refundable Transactions
The following transactions are non-refundable under all circumstances, to the extent permitted by law:
- Monthly and annual subscription fees for TextCloaker Premium;
- Credit purchases (individual or bundled);
- Prorated periods for mid-cycle cancellations;
- Charges incurred due to user error, dissatisfaction, non-use, or failure to cancel in a timely manner;
- Promotional or discounted purchases, including referral-based pricing;
- Any payment processed as part of an auto-renewal cycle.
1.2 No Exceptions
Refund requests will not be granted for, including but not limited to:
- Claims of accidental purchase or duplicate purchase;
- Claims of misunderstanding regarding the Service, its features, or its pricing;
- Dissatisfaction with the quality, output, or effectiveness of the Service;
- Failure to use the Service during a paid period;
- Changes in personal circumstances, financial situation, or needs;
- Technical issues that are attributable to your device, browser, network, or third-party software;
- Claims made after the applicable dispute period has elapsed.
2. Cancellation Process
2.1 How to Cancel
To cancel your TextCloaker Premium subscription, you must submit a written cancellation request via email to:

Subject line must include: "Cancellation Request — [Your Account Email]"
2.2 Cancellation Requirements
- Email is the sole accepted method of cancellation. Requests submitted through other channels — including but not limited to social media, contact forms, in-app messages, Stripe customer portal, or communications with your bank — are not valid and will not be processed;
- You are responsible for confirming receipt of your cancellation request. If you do not receive a confirmation email within 5 business days, your cancellation may not have been received;
- Cancellation requests must include your full name, the email address associated with your TextCloaker account, and your TextCloaker user ID;
- Incomplete cancellation requests may be delayed or rejected.
2.3 Notice Period
All cancellations require a minimum of thirty (30) days' advance notice. During the notice period, one final payment will be processed at your current subscription rate. Your access to TextCloaker Premium will remain active until the end of that final paid billing cycle.
Example: If you submit a cancellation request on August 15, your subscription will renew on September 1 (final payment), and your Premium access will end on September 30.
3. Early Termination
3.1 Minimum Commitment Periods
The following minimum commitment periods apply to TextCloaker Premium subscriptions:

3.2 Early Termination Fee
If you cancel your subscription before the end of the applicable minimum commitment period, you agree to pay the Early Termination Fee specified above. This fee will be automatically charged to the payment method on file at the time of cancellation.
Early termination fees are non-negotiable and non-refundable. Failure to pay the early termination fee may result in the balance being sent to collections.
4. Chargebacks & Payment Disputes
Important: Filing a chargeback or payment dispute with your bank or card issuer without first attempting to resolve the matter directly with us constitutes a breach of this Policy.
4.1 Consequences of Filing a Chargeback
If you initiate a chargeback or payment dispute through your bank, card issuer, or any third-party payment intermediary:
- Your access to TextCloaker Premium and all associated features will be immediately and permanently revoked;
- A Dispute Recovery Fee of $120 will be assessed to cover administrative, processing, and representment costs;
- We reserve the right to pursue reimbursement of all amounts owed — including the disputed amount, the Dispute Recovery Fee, and any applicable collection costs — through collection agencies, legal proceedings, or other lawful means;
- Your account may be permanently banned from the Service.
4.2 Dispute Evidence
In the event of a chargeback, we will provide our payment processor (Stripe) and/or the relevant financial institution with comprehensive documentation demonstrating:
- Your agreement to these Terms and this Policy at the time of purchase;
- Records of your usage of the Service;
- Confirmation that the Service was provided as described;
- Communication history, if applicable.
5. Subscription Auto-Renewal
All TextCloaker Premium subscriptions automatically renew at the end of each billing cycle at the then-current subscription rate, unless canceled in accordance with Section 2 of this Policy.
- It is your sole responsibility to manage, monitor, and cancel your subscription before the renewal date if you wish to avoid further charges;
- We are not obligated to provide renewal reminders, though we may do so at our discretion;
- Pricing is subject to change with a minimum of fifteen (15) days' notice prior to your next renewal date. Continued subscription after notice constitutes acceptance of the new pricing.
6. Credit Purchases
Credits purchased for use with the Service are:
- Non-refundable once purchased;
- Non-transferable between accounts;
- Of no cash value and cannot be redeemed for currency;
- Subject to forfeiture upon account termination or permanent suspension;
- Not subject to expiration under normal account standing, though we reserve the right to implement expiration policies with reasonable notice.
7. Promotional & Referral Pricing
Promotional pricing, referral discounts, and any other special offers are subject to additional terms and conditions as specified at the time of the offer. Promotional pricing applies only for the specified promotional period; upon expiration, your subscription will renew at the standard rate.
Promotional offers cannot be combined, transferred, or applied retroactively. We reserve the right to modify or discontinue any promotional offer at any time.
8. Service Modifications & Discontinuation
We reserve the right to modify, update, or discontinue any feature, functionality, or aspect of the Service at any time. While we strive to maintain and improve the Service, changes to features do not constitute grounds for a refund or credit.
In the unlikely event that we permanently discontinue the entire Service, we will make reasonable efforts to provide advance notice and may, at our sole discretion, offer prorated credits or refunds for unused prepaid subscription periods.

This Policy is governed by and construed in accordance with the laws of the State of Connecticut. Any disputes arising from this Policy shall be resolved exclusively in the courts located in Fairfield County, Connecticut.
